NOTIFICATION OF DEVELOPMENT PERMIT WITH VARIANCES
The District of Peachland Council is considering the following variances to Zoning Bylaw No. 2400 associated with Comprehensive Development Permit Application DP22-08 at 4426, 4440, 4444, and 4450 5th St. in Peachland (Phase 2 of the Peachland Seniors Support Society affordable housing project):
Zoning Bylaw No. 2400:
- Section 6.1.1 (Location of Required Parking and Loading Spaces) to allow the required residential parking and loading spaces to be located off-site;
- Table 6.3 (Total Number of Parking Spaces) to reduce the total number of required parking spaces for residents and visitors from 52 spaces to 49 spaces;
- Section 7.12.11 (Minimum Setback Requirements) to reduce the exterior side yard setback for all storeys above the second storey from 4.5m to 2.1m.
The application will be considered at the Council meeting on Tuesday August 27th, 2024 at 6:00 pm in the Peachland Council Chambers at 4450 6th Street.
These variances affect the 4 properties on 5th St., legally described as
Lots F, G, H, District Lot 490, ODYD, Plan 22267, and Lot 3, District Lot 490, ODYD, Plan KAP63986, as shown outlined on the map –

NOTIFICATION OF DEVELOPMENT PERMIT WITH VARIANCES
5481 Clements Application June 28 2024
The District of Peachland Council is considering the following variances to Zoning Bylaw No. 2400, and Subdivision and Development Servicing Bylaw No. 2395, associated with Comprehensive Development Permit Application DP24-06 at 5481 Clements Crescent in Peachland:
Zoning Bylaw No. 2400
- Maximum building height, s. 7.11.9, from 16.8 m to 21.6 m;
- Location of parking spaces, s. 6.1.1, to allow some required parking spaces to be located off-site, or partially off-site;
- Total number of parking spaces, Table 6.3, to reduce the total number of parking spaces for the development (both on- and off-site) from 142 to 141 spaces;
- Design & landscaping, s. 6.6.8, to allow a parking row longer than 20 spaces without the provision of landscape islands;
- EV charging spaces, Table 6.3, to eliminate the requirement for 1.0 EV charging space per unit.
Subdivision & Development Servicing Bylaw No. 2395
- Schedule 1 – Roads, s. 1.7 – Cul-de-sacs, to reduce the minimum radius of the temporary cul-de-sac at the end of Wild Goose Street from 12.5 m to 7.3 m;
- Schedule 10 – Standard Drawings, to apply a modified SD-R3 road cross section to the construction of Wild Goose Street, including a reduction in sidewalk width from 1.8 m to 1.5 m, sidewalk location(s), and boulevard width.
The application will be considered at a Special Council meeting on Tuesday July 16th, 2024 at 9:00 am in the Peachland Council Chambers at 4450 6th Street.
These variances affect the property at 5481 Clements Crescent in Peachland, legally described as District Lot 220, ODYD, Except Plans B3846, 5230, B7154, 10665, 11334, 16015, 19177, 19728, 20050, 36929, H783, KAP58976, EPP97847, & EPP124417 as shown outlined in the map -

Notification of Zoning Amendment Bylaw No. 2400
The District of Peachland Council is considering Application File: Z24-03 to amend Zoning Bylaw No. 2400 to enact small-scale, multi-unit housing (SSMUH) residential zoning, and is giving first, second, and third readings of Bylaw No. 2422 on June 11, 2024 at 6:00 pm.
The provincial government has enacted the provincial Housing Statutes (Residential Development) Amendment Act, often referred to as: Bill 44 Small-scale, Multi-unit Housing (SSMUH), which requires that local governments permit up to four housing units on properties exclusively zoned for single residential or duplex uses. Local governments must amend zoning bylaws to conform to the legislation by June 30, 2024. Provincial legislation prohibits the holding of a public hearing to adopt zoning amendments required by Bill 44.
The purpose of the amendment bylaw is to amend Zoning Bylaw No. 2400 to create a new R1 zone that replaces the existing R1, RC1, and R2 zones and to create a new RM2 zone.
Zoning Amendment Bylaw No. 2422 primarily affects all properties in the District of Peachland that are connected to community water and sewer services and have been zoned for single residential or duplex uses.
